Terms of Use.

FaustWave is in early access; these terms may be updated as the service evolves.

§ 1 Scope and Provider

These Terms of Use govern the use of the FaustWave IDE (the "Software") and the FaustWave Hub (the "Hub"; together, the "Service"). The provider and contracting party is Manfred Weber (contact and address details in the Legal Notice). By downloading or using the Software, or by registering an account, you accept these Terms of Use.

§ 2 Description of Service, Early Access

The Service is in an early stage of development (Early Access) and is provided free of charge. The Software is a local development environment for audio DSP based on Faust. The Hub allows registered users to store their own content (e.g. patches, libraries, sample and IR packs, project archives) and – depending on the visibility selected – to share it with others. The scope of features and availability may change at any time; there is no entitlement to specific features or to uninterrupted availability.

§ 3 Rights of Use in the Software

The provider grants the user a simple, non-exclusive, non-transferable right to use the Software for its intended purposes. Modification, decompilation, or reverse engineering is permitted only to the extent mandatorily allowed by law. The licence terms of individual bundled components (in particular open-source components) remain unaffected and prevail over these terms in case of doubt.

§ 4 Registration and User Account

Use of the Hub requires a user account. The user is obliged to provide truthful information, to keep their access credentials confidential, and to report any misuse without delay. The user is responsible for actions carried out via their account to the extent they are accountable for them.

§ 5 User Obligations, Acceptable Use

The user undertakes not to misuse the Service. In particular, it is prohibited to submit or distribute unlawful content, to infringe the rights of third parties (e.g. copyright, trademark, or personality rights), to distribute malware, to disrupt or unreasonably burden the operation of the Service, or to circumvent technical protection or access restrictions.

§ 6 User-Submitted Content

The user retains all rights to the content they submit. The user grants the provider the simple right, limited to the duration of storage, to store this content, reproduce it technically, and make it available or accessible to other users in accordance with the visibility selected by the user, to the extent required for the operation of the Service. The user warrants that they hold the necessary rights to the submitted content and that its submission does not infringe the rights of third parties. The provider is entitled to remove unlawful or infringing content.

§ 7 Availability, Warranty

The Service is provided in its respective available state ("as is"). As the Service is provided free of charge and within an early stage of development, the provider gives no warranty as to any particular quality, fitness for a particular purpose, or uninterrupted availability. Mandatory statutory rights of the user remain unaffected.

§ 8 Liability

The provider is liable without limitation for intent and gross negligence, and for damages arising from injury to life, body, or health. In cases of simple negligence, the provider is liable only for the breach of an essential contractual obligation (an obligation whose fulfilment is a prerequisite for the proper performance of the contract and on whose observance the user may regularly rely) and limited in amount to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 9 Data Backup

The user remains responsible for backing up their own data and content. We recommend keeping an additional local backup of important content.

§ 10 Term and Termination

The usage agreement is concluded for an indefinite period. The user may delete their account at any time via the account settings. The provider may terminate the usage relationship with reasonable notice and, in the event of breaches of these terms, may suspend the account or remove content. The right to extraordinary termination for good cause remains unaffected.

§ 11 Changes to the Terms

The provider may amend these Terms of Use where required for good reason (e.g. changes to the scope of features or to the legal situation). Users will be informed of material changes in an appropriate manner. If the user continues to use the Service after a change takes effect, the amended terms are deemed accepted; this will be pointed out separately in the notice.

§ 12 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the user has their habitual residence remain unaffected. Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions remains unaffected.
